Environmental Requirements

Each MDOT transportation business unit maintains an updated list of all legal and other requirements to which they are subject. The majority of legal requirements are found in the U.S. Code of Federal Regulations (CFR) Title 40 and Code of Maryland Regulations (COMAR) Title 26. Local codes only apply to state facilities where delegated by state and federal regulations.

Other regulatory programs, such as the National Environmental Policy Act (NEPA), are applicable to the planning, design and construction aspects of Department activities. Click the link for more information.

ONE FEDERAL DECISION. The White House announced that agencies involved in environmental review of major infrastructure projects have signed a Memorandum of Understanding (MOU) implementing Executive Order 13807, which is commonly referred to as One Federal Decision. In accordance with the MOU, federal agencies agree to establish a coordinated and timely process for environmental reviews of major infrastructure projects.
