Environmental Requirements

Each MDOT transportation business unit maintains an updated list of all legal and other requirements to which they are subject. The majority of legal requirements are found in 40 Code of Federal Regulations (CFR) and Code of Maryland Regulations (COMAR) Title 26. Local codes only apply to state facilities where delegated by state and federal regulations.

Other regulatory programs, such as the National Environmental Policy Act (NEPA), are applicable to the planning, design and construction aspects of Department activities. Click the link for more information.

Regulatory Updates

On January 12, 2017, EPA issued a final rule (82 FR 3633) to adjust the level of statutory civil monetary penalty amounts under the statutes EPA administers. This most recent adjustment follows a major adjustment finalized in July 2016 (81 FR 43091). The adjusted amounts apply to penalties assessed after January 15, 2017 for violations occurring after November 2, 2015.  The full list of EPA’s new penalty amounts can be accessed here.
